The first part of the statement from her rep -- described by AP as "Representatives for Angelina Jolie Pitt" -- on the agreement which was released to all outlets tonight:
"We can confirm that childcare professionals have encouraged a legal agreement accepted and signed by both sides over a week ago. In accordance with this agreement, the six children will stay in their mother's custody, and the children will continue therapeutic visits with their father. This has been determined by childcare professionals to be in the children's best interest."
So like Bert Fields, her rep (Judy Smith?) identifies herself as a rep for "Angelina Jolie Pitt"
Apparently the DCFS encouraged them to sign this agreement that gives Angelina the legal basis she needs to keep the children with her and separate from Brad with Brad agreeing to "therapeutic visits." And this may be the first step towards the DCFS easing its restrictions on Brad as ET reports that they spoke directly. ET adds that "this agreement is separate from the voluntary safety plan implemented by the Department of Child and Family Services that was extended last month."
“From the beginning, Brad only wants to do what’s best for the children," a source tells ET
ET's earlier source further says
“The agreement is also indefinite, so there is no time frame to it, it is in place until they decide to make a change... This is a good sign, it is the first step. This means one issue is now off the table for them.” "Back when Angelina first filed for divorce, she said that the reason she filed was for the safety and health and well-being of the kids and that has been her consistent point of view from the beginning,” the source explained. “Nothing has changed.”
"one issue is now off the table for them" - but as far as the divorce case is concerned it is the "only" issue.
AP notes that "The agreement has not been filed in the couple's divorce, and may not be the final custody arrangement governing the actors' children."
ET adds that "the 52-year-old actor will not be withdrawing his petition for shared custody, as it “preserves his rights in the future.”
At the time he submitted his response and even before he signed the document, they had already signed this new agreement.
It is even clearer now that his response to her petition was never about his concern regarding custody. So I still believe that his filing a response was all about the DCFS investigation remaining open.
Since this was signed "over a week ago" they released the info only now to allow Brad time to file his response without people immediately questioning why it was even necessary. But they want us to know that Brad was never concerned about custody which is why they told us when it was signed.
The statement then also serves the additional purpose of putting an end to the "divorce and custody war" narrative that almost all gossip sites have been eagerly promoting.
I believe the agreement was not filed in the divorce case because the divorce case will not be having a role in their future. This agreement will likely out-live the divorce case.
There is no question that at some point Angelina will not need sole custody and the children will be deemed safe to be with their father without restrictions. The big question has always been when the DCFS would rule that way. Again, the three things that I think will determine when the DCFS closes the case are: Brad's dealing with his problems, the DCFS completing their interviews on all incidents involving Brad that they are investigating, and the children being deemed by the therapist as ready.
Note again the familiar, careful wording of the rest of the statement:
We hope now that it is s clear that the events which led to the dissolution filing involved minor children and their wellbeing, there will be understanding of the sensitivity of the family situation. We believe that all sides are committed to healing the family and ask for your consideration during this difficult time."
The events that led to the dissolution filing -- the filing and not the actual end result of getting a divorce is what has always been emphasized. A "family member" whom I suspect was her brother used very similar phrasing last Sept. "Her children are recovering from the events that brought about the filing of the divorce."
involved minor children and their wellbeing - it was never about the two of them or their relationship
all sides are committed to healing the family - all sides, with again the consistent message of healing the family. Since its "all" and not "both" are they also referring to the DCFS?
"Healing the family" should commence as soon as the DCFS closes the case -- which however doesn't sound like it is imminent as the children still need "therapeutic" visits.
A curious wrinkle is TMZ hurriedly posted a rebuttal but in lieu of the usual "sources close to Angelina," it just says "multiple sources." It appears there may have been a falling out between Wasser and TMZ. Was she (or perhaps it was Angelina) unhappy with TMZ's post that was headlined "Brad's Dreaming -- He's not getting Joint custody?"
"Multiple sources familiar with the situation are scoffing at the report that the divorcing couple struck a settlement giving Angelina primary physical custody while Brad got visitation."...In fact, the couple agreed to extend the temporary arrangement ONLY until the L.A. County Dept. of Children and Family Services closes its investigation."It is certainly embarrassing for TMZ, which just posted their latest report this morning, to apparently not have been sent a copy of the statement. In the wake of the report now carried by all news outlets, no one is paying attention to TMZ's hissy fit. It was a good run for TMZ while it lasted but now Angelina's team has clearly moved on.
