TMZ broke the news of Brad's response at 4:44 PDT yesterday. They previously also broke the news about Angelina's filing
So far, what we know as facts from the her petition and his response is:
She wants sole physical custody with visitation and joint legal custody
He want joint physical and legal custody
She did not ask for her name to be changed back to Angelina Jolie from Angelina Jolie Pitt
She did not mention a prenup or ask for spousal or child support.
He also did not mention a prenup or spousal or child support.
So they have an "iron clad" prenup that neither is seeking to enforce?
Sources close to the couple tell us their prenuptial agreement is ironclad and details the specifics of their combined fortune ... a reported $400 mil.
Brangelina have 12 total properties together ... all of which they snatched up either before they were married or before they were even dating. 7 of those belong to Brad, 2 to Angie and 3 which they bought together prior to tying the knot in 2014.
It's unclear who exactly shelled out what for those 3 properties, which include a vineyard in France, a mansion in New Orleans and an apartment in NY ... but we're told the prenup makes divvying all that up simple.
I previously posted that in a discussion shortly after Angelina filed for divorce in USAToday, a divorce attorney said,
"It's significant that Jolie mentioned nothing about a prenup in her divorce petition.
"Usually when we (lawyers) file a petition, if there is a prenup we indicate that — unless we don't like it," says Hallin. "When (Pitt) files his response, he will say in there whether he wants to enforce (a prenup)."
But he didn't mention it either.
And nothing on child support from either of them.
From Angelina's petition, the section on support and property.
A reader (Bia) pointed out that CNN
Pitt cites irreconcilable differences and asked the judge to grant him more time to figure out a property agreement. Together the couple own homes in Los Angeles, New Orleans and France. So they don't agree on custody but he will figure out a property agreement for both of them.
Interesting isn't it that their "prenup makes divvying all that up simple" but he didn't mention it and is asking for "more time to figure out a property agreement."
I speculated in my previous post that his response was buying them time, keeping the divorce petition credibly in place while they wait for the DCFS to close its investigation
It took him one month + 2 weeks to file his response.
Actually he had one month + 2 weeks + 2 days to think about his reponse:
"“He is just wrecked by this,”“He got a heads-up [about the filing] two days before
When the temporary recommendations were first released by the DCFS
We're told Angelina agreed with recommendation because her focus is to "heal" her family and her children.
At the time, I noted "The 2nd to last line in TMZ's post was edited from the original "We're told Angelina is happy with the agreement and her focus is to "heal" her family." to "We're told Angelina agreed with recommendation because her focus is to "heal" her family and her children."
...The new sentence acknowledges that the family as a unit needs healing and that the children as individuals also need healing. It is also in line with her rep's statement that she will "do what's in the best interest of taking care of her family"
So from the filings, the only thing that is clear is that they disagree on custody.
When TMZ reported on Brad's first meeting with Maddox:
Sources connected with Angelina tell us the 2 met Wednesday afternoon with a therapist present. There had been a plan in place for Brad and Maddox to reunite a while back, but we're told the therapist felt the timing wasn't right.
The sources say Brad has had visits with his 5 other kids before Wednesday, but the face-to-face with Maddox is a turning point.
Our Angelina sources say, even though she's headed to divorce court, she still wants their family to function with a fully involved father and mother.
"She wants their family to function with a fully involved father and mother."
I already noted that that has a different meaning from saying "she wants their children to have a fully involved father and mother."
After divorce, the "family" as a unit ceases to exist. If they are living separate lives you will have a mother + children and a father + children but they are no longer a "family."
In one of the few articles Mary Green wrote for People just days after she filed on Sept. 24.
"A family member exclusively tells PEOPLE "Her family is broken and she is in agony. Her children are recovering from the events that brought about the filing of the divorce"
That is why for her "healing the family is the priority."
The People article reporting on Brad's response was edited to add the following:
The children remain continue to live with Jolie and a source close to the situation tells PEOPLE: “The kids are Angie’s sole focus. She’s cancelled everything else – work, everything. She’s been home each day, supporting them, helping them with homework, been there constantly. And no, this isn’t with a big staff of nannies and helpers.”
It bears remembering:
A source connected with Angelina says this is not about alcohol ... she would never leave Brad if it was just a substance abuse problem. The source says this is all about protecting their children.
another source previously told Us. “She wants them to have a relationship with him once their health and safety is assured.”
For the investigative sleuths, from Brad's response we know that the divorce petition is
case no BD 646 058 and is being heard by Judge K Diesman, Dept 27
